Address on Income Tax Form Not in my Resident State?

I’m a consultant who travels often for my job. My home office is located in VA and for tax purposes this is also considered my tax state. I no longer rent in VA given that I travel weekly for my job. Normally, I spend my weekends in Chicago with my boyfriend. Am I allowed to use a non VA address when filing my Federal and Virginia state tax forms…given that I currently don’t have a place in VA? If this isn’t possible, can I use a business address on personal income tax forms. My office is located in Virginia. FYI – not interesting in transferring offices to Chicago. Would like Virginia to remain as my state of residence.

Virginia recognizes two types of residents: domicilliary and actual. You are considered a domicilliary resident of Virginia until you set up a permanent residence in another state. And Virginia won’t count spending weekends in Illinois as setting up permanent residence. So you will be still be considered a Virginia resident. Yes, you may file with an out-of-state address. And Virginia is notorious for going after people who travel for their job, knowing they rarely establish a “domicile” in a new state.

Now, Illinois may also consider you a resident (I deal primarily with East Coast states, so I don’t know Illinois tax law). So it is theoretically possible to be a resident of both states, if you meet Illinois’s criteria.
